Arkansas Law on Drug Possession
Under Ark. Code Ann. § 5-64-419, possession of a controlled substance is a crime, and the penalty depends on the schedule of the drug and the amount involved.
Marijuana (Schedule VI)
- Less than 4 ounces (first offense): Class A misdemeanor (up to 1 year in jail, fine up to $2,500).
- 4 ounces to 10 pounds: Class D felony (up to 6 years in prison, fine up to $10,000).
Prescription Drugs / Schedule I or II Substances (e.g., cocaine, meth, opioids)
- Less than 2 grams (Schedule I or II): Class D felony.
- 2–10 grams: Class C felony (3–10 years in prison).
- More than 10 grams: Class B felony (5–20 years in prison).
Other Controlled Substances (Schedule III, IV, or V)
- Less than 28 grams: Class A misdemeanor.
- More than 28 grams: Class D felony.
